Metro Nashville must pay nearly $57K in attorneys fees in public records case

Senior Judge Robert E. Lee Davies ordered Metro Nashville to pay nearly $57K in attorneys fees to a public records requester, saying that the city "misinterpreted and ignored the 'promptness' requirement" in the Tennessee Public Records Act. Davies found the city was willful in not complying with the law, a requirement for awarding attorneys fees in a public records lawsuit. Senior Judge Robert E. Appeals Court reverses denial of attorney fees in public records case

The Court of Appeals in Nashville reversed a trial court ruling, and ordered attorney's fees be awarded to Alex Friedmann, managing editor of Prison Legal News, who sued the Marshall County Sheriff's Office after it refused to let him get copies of written jail policies and contracts unless he appeared in person. Friedmann wrote a letter to the sheriff's department requesting copies under the Tennessee Public Records Act of certain jail policies and contracts. Alex Friedmann, managing editor of Prison Legal News, has filed a request to appeal a Marshall County chancery court ruling last year that ordered release of records he requested, but declined to rule that one of his requests was denied because he would not appear in person to make the request. Friedmann began his request Feb. 3, 2014, with a letter to the Marshall County Sheriff's Department requesting disclosures of jail policies concerning inmate mail, inmate grievance policy, inmate medical care policies, whether the jail maintains a formulatory of medications for inmates, a copy of the jail's phone service contract, a contingency request if the jail is paid a commission on prisoner [...]
