TCOG lists 13 exemptions, exemption categories that need revision or elimination

Tennessee Coalition for Open Government recently provided the Open Records Ad Hoc Committee 13 exemptions or categories of exemptions that are interfering with the public's right to know what government is doing. Deborah Fisher, executive director of TCOG "As you will see, many of the exemptions listed have problems related to overbreadth or vagueness that we suspect may exceed the public purpose of the exemption. We know that some of the considerations we are bringing forward were not part of the debate when the exemptions were passed by the legislature," TCOG's letter said. Lawmaker faces opposition in trying to open up state lottery records

State Sen. Jon Lundberg, R-Bristol, is facing stiff opposition in his effort to open up state lottery records. State Sen. Jon Lundberg, R-Bristol, doesn't buy the lottery's arguments that retailers will leave the system if sales were made public. According to a story in the Bristol Herald Courier, the Tennessee Lottery says it would lose $19.5 million in revenue if it had to reveal lottery sales by retailer, information that is public in other state lotteries, including in two states bordering Tennessee. The reasoning? The risk of robberies to stores will increase if sales were revealed, and other retailers would know how much they are making through such sales. [...]

Bill to scale back confidentiality of lottery sales

Legislation has been filed that would remove an exemption that makes the location of lottery sales secret under state law. Rep. Jon Lundberg, R-Bristol Rep. John Crawford, R-Kingsport The proposed bills (S.B. 563 / H.B. 575) by state Sen. Jon Lundberg, R-Bristol, and Rep. John Crawford, R-Kingsport, states as the reason "that transparency in the operation of the state lottery is essential to maintaining public confidence in the Tennessee education lottery corporation, lottery vendors, lottery retailers, and lottery games." Bristol newspaper gets lottery data in Virginia, but same records are secret in Tennessee

The Bristol Herald Courier reported in a Sunday story a geographical sales analysis of lottery data. But it could only tell half the story. Why? The line that separates Bristol, Tenn., from Bristol, Va. is also the state line. While it could report data from Virginia lottery sales in Bristol, Va., the same data from the Tennessee lottery in Bristol, Tenn., is confidential  under an exemption in the Tennessee Public Records Act. In Bristol, Va., half of the largest retailers of lottery tickets sell their tickets in an area that is home to some of the city's lowest-earning residents.
