The Johnson City Press Opinion Page Editor Robert Houk penned a strong column on the need for governing bodies to make sure citizens can hear their deliberations during a public meeting. He was writing in reference to a lawsuit in Greene County where citizens are suing the Industrial Development Board on allegations that it violated the Open Meetings Act when it held a meeting where parts of the deliberations were inaudible. Greene County IDB argues citizens don’t have a right to hear deliberations at public meetings

The County Industrial Development Board of Greeneville and Greene County is arguing in a lawsuit that the Open Meetings Act does not require that citizens be able to hear deliberations of a governing body at public meetings, only that they be given the opportunity to be present. The arguments are found in filings to try to dismiss a complaint made by 47 people, many who live or own property along the Nolichucky River, who say that the Industrial Development Board violated the law when it held a July 18 meeting, but “purposefully or negligently prevented (citizens in attendance) from hearing deliberations…” The citizens note that board members “conducted deliberations while sitting [...]

Charges against Eddie Overholt dropped

Charges were dropped against the citizen who was arrested after asking members of an industrial development board in Greene County to speak up in a public meeting so citizens could hear, news outlets in East Tennessee have reported. Eddie Overholt was among several citizens at the July 18 meeting who were interested in the board's efforts to help an industrial plant who wanted to draw and discharge water into the Nolichucky River. Although the room had microphones, the board members did not use them. After Overholt's arrest, 59 complaints about a potential violation of the Open Meetings Act were filed with the state's Office of Open Records Counsel, Elisha Hodge. [...]

It’s not every day that a citizen gets cuffed, arrested and ejected from a public meeting in Tennessee. But that’s what happened, famously, to Eddie Overholt in Greene County last month where he faces charges of disrupting a public meeting and resisting arrest. Eddie Overholt, Industrial Development Boards and their problem with Sunshine laws

Last month, a Hamilton County judge ruled that Chattanooga's industrial development board violated the Open Meetings Act in a decision to give tax money to a developer to build a golf course community on a mountain. This month, Office of Open Records Counsel Elisha Hodge warned the chairman of the Greene County Industrial Development Board, Alan Broyles, that an inaudible meeting violates the state's Open Meetings Act.
